Local arrested for drunk in public, kicking and biting E-mail
Friday, 16 January 2009
On Wednesday, Jan. 14, at approximately 9:30 p.m., MLPD officers responded to the Clocktower Cellar in response to a disturbance report. When officers arrived, they saw Clocktower staff escorting a woman later identified as Amber Jean Ruiz Rodriguez, 27, of Mammoth Lakes out of the bar. Officer Schwartzkopf attempted to calm Rodriguez and get her side of the story, but she was extremely intoxicated and became combative with the officers. She was arrested, handcuffed and placed into a police unit. Rodriguez then began kicking the door and window of the police unit attempting to damage it and break out the window. Sergeant Dostie and Officer Smalley opened the car door to prevent her from injuring herself and when they opened the door, Rodriguez began kicking at them. Sergeant Moscowitz decided to apply a leg restraint to secure Rodriguez’ feet to the floor of the vehicle to keep her from injuring officers, herself, or damaging the police unit. Rodriguez was then transported to MLPD for booking.

At MLPD, Rodriguez said she would cooperate and the leg restraint was removed to allow her to walk into the station. As soon as the restraint was removed and she entered the station, she began kicking and using her legs and feet to strike at officers. The leg restraint was reapplied and it was determined that she would be directly transported to Mono county Jail due to her combative behavior. Rodriguez refused to walk or cooperate in any way and officers were forced to carry her outside to a transport vehicle. When officers were attempting to put her in the vehicle, Rodriguez bit Sgt. Moscowitz on the right forearm refusing to let go for several seconds. Sgt. Moscowitz suffered a bite wound through his uniform and jacket.

Rodriguez submitted to a breath test at Mono County Jail roughly ten and a half hours later at 7:53 a.m. Her blood alcohol content was 0.095 (still higher than the legal limit to operate a vehicle at 0.08) Rodriguez was charged with disorderly conduct: alcohol and battery on a police officer causing injury. Rodriguez remains in Mono county Jail awaiting arraignment.
